Regularisation of unauthorised internal alterations on Brighton’s historic seafront

Problems arose for the owners of a flat in one of the impressive Grade II listed Georgian townhouses on Marine Parade, when coming to market their flat they discovered the internal alterations undertaken by the previous owners had no listed building consent.

The removal of internal walls and the creation of an open plan space more than 10 years previously had no listed building consent or building regulations approval. This raised the issue of removal of historic fabric without permission as well as leaving the occupants in a top floor flat with no means of protected escape from fire.

Cath negotiated a retrospective listed building consent, based on revised layout that maintained the sea views of the open plan flat with a protected means of escape that complied with building regulations.

The regularisation of the alterations to the listed building facilitated the completion of the sale and allowed the vendors to pass the approved alterations onto the purchaser.
